Terms of use
1. General
1.1. The terms and conditions of use of the online shop (hereinafter the terms and conditions of use) regulate the use of the online shop (hereinafter the online shop) located at www.raum.ee and the terms and conditions of sale of modular saunas (hereinafter the sauna) sold through the online shop.
1.2. The owner and administrator of the online shop is Raum OÜ (hereinafter Raum), address Lääne-Viru County, Rakvere, Tootmise tn 6, 44317, commercial register code 10855926, e-mail: karl@raum.ee, telephone (+372) 32 55 672.
1.3. The customer can buy the saunas offered in the online shop. Any natural or legal person of legal age can become a client.
1.4. When purchasing a sauna, the customer enters into a sauna sales contract with Raum, which is subject to the terms of use and privacy policy. The terms and conditions of use of the online shop also apply to all other persons who visit the online shop, and by visiting the online shop, the person confirms that he or she has accepted the terms and conditions of use and undertakes to comply with them.
1.5. By placing an order, the customer confirms that all the information he/she has provided is correct, that he/she is a natural person with full legal capacity and, acting as an agent, that he/she has all the rights and powers to purchase a sauna on behalf of the customer. The accuracy of the confirmations made by the customer and the customer’s representative is assumed and Raum is not obliged to verify it.
1.6. The price of the sauna offered in the online shop is given in euro. All prices in the online shop include VAT.
1.7. Raum may change, modify, supplement, replace or delete the Terms of Use, Privacy Policy and the price, terms of sale and other information about the sauna offered in the online shop at any time at its sole discretion.
1.8. Changes and amendments to the Terms of Use, the Privacy Policy, the sauna price and other information will take effect from the moment the changes are made in the online shop. If the customer has placed an order before the change comes into force, the terms and conditions in force at the time the order was placed will apply.
2. Placing the order, paying for the sauna and transport.
2.1. To buy a sauna from the online shop, the customer must select the sauna, choose the accessories (electricity, finishing, etc.) and add the location where the sauna will be installed. The sauna is added to the shopping cart and the price is displayed to the customer.
2.2. Adding a sauna to the shopping cart does not commit the customer to purchase. The customer can modify the sauna in the shopping cart and, if necessary, remove it until the order is confirmed.
2.3. The price of the sauna includes transport to the location of the customer’s choice and installation.
2.4. The customer can pay for the sauna by bank transfer, bank transfer, credit card, instalment or any other payment method offered by Raumi. At least 50 % of the price of the sauna must be paid before the order is confirmed. When paying by instalment, the customer will be redirected to the ESTO instalment environment where the customer can complete the instalment application.
2.5. After the purchase has been made, Raum sends an order confirmation to the customer’s e-mail address and informs them of the estimated delivery time.
2.6. Raum will do its best to fulfil the customer’s order and deliver the sauna to the customer on time, but reserves the right to reject the customer’s order if it proves impossible to fulfil the order, regardless of the reasons. Raum will inform the customer as soon as possible of any changes to the order.
2.7. Raum will do its best to keep the information, including the description, specifications and prices of the sauna in the online shop accurate and up to date at all times. However, the customer is aware that the information published in the online shop is informative, that the photos of the sauna are illustrative and that the final appearance and specification of the sauna may differ from that shown in the online shop.
3. Returning the sauna
3.1. The consumer customer has the right to return the sauna to Rauma within 14 days from the date of receipt of the sauna, unless the customer does not have the right of withdrawal pursuant to Section 53(4) of the LOA. The customer has the right to return only unused sauna.
3.2. If the customer wishes to return the sauna, a request must be sent by e-mail to karl@raum.ee with their details and bank account number.
3.3. In the event of a return of the sauna, the customer shall return the sauna to Raum without delay, but not later than 15 days from the date of the request. The returned sauna must be unused.
3.4. Raum will transfer the money for the returned sauna back to the customer’s bank account as soon as possible, but not later than 15 days after receipt of the returned sauna. The costs related to the return of the sauna, including transport costs, are borne by the customer.
4. Non-compliance of the sauna with the conditions of sale
4.1. Raum shall be liable for the non-compliance of the sauna sold to the customer with the conditions of sale which existed at the time of delivery of the sauna to the customer and which becomes apparent within two years of delivery of the sauna. Raum is not liable for any defects arising after the delivery of the sauna.
4.2. In the event of non-compliance with the terms and conditions of sale of the sauna, the customer must submit a complaint to the e-mail address karl@raum.ee, stating the customer’s name, contact telephone number, order number and a precise description of the non-compliance with the terms and conditions of the sauna. The customer has the right to contact Raum within 7 days of the defect becoming apparent. Raum will review the complaint and respond to the customer as soon as possible, but no later than 15 days after receipt of the complaint.
4.3. Damage in transit must be reported to Raum as soon as possible, but no later than 3 working days from the date of receipt of the sauna.
5. Sales guarantee
5.1. Raum provides a sales guarantee for the sauna for a period of 5 years from the date of receipt of the sauna by the customer.
5.2. In the event of defects or faults in the sauna during the warranty period, which are not due to natural wear and tear or improper use by the customer, Raum will cover the cost of repairing or replacing the sauna.
5.3. In the event of defects or deficiencies in the sauna, the customer must submit a complaint to the e-mail address karl@raum.ee, stating the customer’s name, contact telephone number, order number and a precise description of the defects or deficiencies in the sauna.
5.4. In the event of defects or deficiencies in the sauna during the warranty period, Raum will decide, according to its reasonableness, whether to replace, repair or otherwise compensate the customer.
6. Copyright
6.1. All the information contained in the online shop, including the design and software of the online shop, is protected by copyright in accordance with copyright law. All copyrights in the materials presented in the online shop are owned by Raum or have been granted to Raum to the extent that their use in the online shop is permitted.
6.2. The information contained in the online shop may only be used for non-commercial purposes and copying, reproduction, distribution or any other form of transfer of the information contained therein to third parties without the prior written consent of Raumi is prohibited.
7. Information that the online shop stores (cookies or “cookies”). cookies )
7.1. Raum uses cookies to ensure a better user experience, usage statistics, security and more effective marketing activities in the online store.
7.2. Cookies are small text files that are stored in the memory of the client’s device by the web pages visited. There are session cookies (temporary cookies), designed to enable the use of the service, and persistent cookies (stored on the customer’s computer after closing the browser), designed to remember the customer’s choices in the online shop.
7.3. Raum uses the following cookies:
– analytical cookies, which collect information about how the online shop is used, e.g. which pages are visited the most, what visitors search for in the online shop, etc. These cookies do not collect any information that would allow the online shop to directly identify the customer. This includes, for example, Google Analytics cookies.
– advertising cookies to help deliver ads targeted to the interests of the customer. For example, the Facebook Pixel, which allows you to see your online shop ad on Facebook.
7.4. Raum collects statistical data from the online shop in the Google Firebase (analytics.google.com) environment for statistical analyses, and the collection and storage of data is subject to the terms and conditions of that environment.
7.5. The customer may disable or delete cookies in their browser settings, but in this case Raum cannot guarantee the correct functioning of the online shop.
8. Other conditions
8.1. All notices and information provided by Raum to the customer will be sent in electronic form to the e-mail address provided by the customer when placing the order.
8.2. All notifications and information provided by the Customer to Raum shall be sent via the online shop or via the e-mail address provided in the Terms of Use.
8.3. The Customer undertakes to compensate Raum for any direct material damage caused by the Customer’s breach of the Agreement, including the Terms of Use.
8.4. The contract shall remain in force until the fulfilment by the parties of their obligations under the contract.
8.5. The Contract shall be governed by the law in force in the Republic of Estonia.
8.6. Disputes arising from the contract will be resolved by negotiation between the client and Raum. In the absence of an agreement, the dispute is settled in the court of the defendant’s domicile.
8.7. If disputes cannot be resolved by negotiation, the consumer customer can also turn to the Consumer Protection and Technical Regulatory Authority (Endla 10A, 10122 Tallinn, www.ttja.ee) for advice and clarification, or refer the dispute to the Consumer Disputes Committee. Complaints can also be submitted to the Consumer Disputes Committee via the online dispute resolution platform at http://ec.europa.eu/odr, and the rules of procedure of the Committee can be found at www.ttja.ee.
